Administrative staff

Doctors employing administrative staff for their practice have several options available.

Administrative staff can be employed under the relevant Award, under an Enterprise Agreement (EBA), an Individual Flexibility Agreement (IFA) or a contract. The Award represents the minimum benefits and conditions.

One of the less spoken about aspects of the new workplace relations legislation is a requirement of employers to complete and retain employment records for their employees. More here.

Awards

Most administrative employees within a private medical practice in Victoria are subject to the minimum terms and conditions of employment set out in the Health Professionals and Support Services Award 2010. This Award excludes Doctors and Nurses.

Practice Nurses

Practice nurses are subject to the Nurses Award 2010 whether they are Division 1 or Division 2 nurses.

AMA Victoria provides an Award Subscriber Service at low cost to members which explains their obligations under the above awards and keeps them up to date with changes to the awards.

Enterprise Agreement (EBA)

An Enterprise Agreement is an agreement between employers and the relevant group of employees defining the terms and conditions for the employment of those employees. To be valid it must be registered with Fair Work Australia. The terms of an Enterprise Agreement take precedence over an Award.

Individual Flexibility Agreement

An Individual Flexibility Agreement (IFA) is an agreement reached consistent with Clause 7 of the Award. A practice can vary some award provisions if they follow a proper process and the employee genuinely agrees and is better off overall.
