Public Holidays

The vast majority of medical practice staff employed in Victoria will have their public holiday entitlements determined by their Federal Award and the National Employment Standards (NES). For nursing staff the Award is Nurses Award 2010, and for administrative and health professionals the Health Professionals and Support Services Award 2010 (HP&SS).

Payment for working on a Public Holiday

Where an administrative employee is required to work on a public holiday he or she is to be paid at double time and a half for all time worked (CL32.2 HP&SS). Double time for Nurses (CL32.1 Nurses). Where an employee might otherwise have worked eight hours, but because it is a public holiday they only work four hours and have the other four hours off, they would be paid double time and a half for the four hours worked, and ordinary time for the other four hours not worked (S116 NES).

An employee not covered by a Federal Award, such as medical practitioners employed as assistants, has his or her public holiday entitlements determined by the provisions of the NES. Although Easter Saturday is listed as a public holiday under the Act, the entitlement is to have a `public holiday … without loss of pay’ – in other words the employee would only be paid had he or she otherwise been rostered to have worked that Saturday. If the employee is required to work he or she may agree on another day in substitution.
