What are collective agreements and which cover my employment?
Collective industrial agreements include Enterprise Agreements, which are collective agreements approved under the Fair Work Act 2009, and Certified Agreements, which are older collective agreements registered under the Act.
These types of collective agreements have the full force of federal law, and are enforceable in the Federal Court of Australia. A characteristic of these collective agreements is that they remain in force until they are replaced by a new agreement made under the Act.
The following collective agreements apply to hospital specialists in Victoria. You should check to ensure which agreement applies to your position. This can be done by reading the clause that deals with the 'incidence and parties bound'. It will detail which specialist positions are bound to the agreement.
When reading the agreement you also need to read the 2006 and 2009 Heads of Agreement. To the extent of any change the more beneficial terms of the Heads of Agreement apply.
If your position is not covered by a collective agreement, you should refer to the Hospital Specialists and Medical Administrators Award 2002 and the Medical Practitioners Award 2010.
